(AL.com) A federal judge ruled today against an Alabama death row inmate who sought a stay of execution to litigate his claim that prison officials are violating his religious rights because they won’t allow his Muslim spiritual adviser to be with him in the execution chamber.
Domineque Ray, 42, filed a lawsuit Monday claiming that the ADOC’s denial of the request violates federal law and the U.S. Constitution’s prohibition on government establishment of a religion.
Chief U.S. District Judge Keith Watkins of the Middle District of Alabama held a hearing on Thursday and issued his decision today denying the stay of execution.
Ray is scheduled to be executed by lethal injection Thursday at 6 p.m. at Holman Correctional Facility in Atmore.
